Terms of Service
Good food starts with care. So does doing business. Here is what you can expect when you order from us, give tacos, or spend time on our website.
Effective
1. Who we are & how these terms work
Vermont Tortilla Company is operated by Pure Masa LLC, a Vermont business. In these Terms of Service, “we,” “us,” and “our” mean Pure Masa LLC; “you” means the person using our website or buying from us. These terms cover our website, direct online purchases, gift cards, and related services.
Please read these terms before ordering or using our services. When you accept them at checkout or through another service that presents them, they form an agreement between you and us. If you do not agree, please do not complete that transaction or use that service. You can save or print this page for your records.
Our Privacy Policy explains how we handle personal information. Our Returns & Refunds Policy is part of our purchase terms. Specific offer terms shown before purchase apply to that offer. A separate written agreement we both accept, such as a wholesale agreement, controls if it conflicts with these general terms. Your mandatory consumer rights always apply.
2. Eligibility & account information
To place an order, you must be old enough to enter a binding contract where you live, or have a parent or legal guardian make the purchase. If you order for a business, you must have authority to act for it.
Please provide accurate contact, billing, delivery, and gift-recipient details. If you use an account, keep its information current and protect your password and sign-in codes. Let us know promptly if you suspect unauthorized use. You are responsible for activity you authorize; this does not take away legal protections for unauthorized transactions.
3. Our products & product information
We make organic corn tortillas in Essex, Vermont. Food made from agricultural ingredients can vary naturally in color, texture, and appearance. Photos illustrate our products; the item description identifies what is included in your purchase.
We work to keep ingredients, pack sizes, prices, and availability accurate. Read the current product information and the label on the package you receive, especially if you have an allergy or dietary requirement. If they differ in a way that affects your purchase, contact us so we can resolve it. Natural variation does not excuse an unsafe, defective, or incorrectly described product.
4. Orders & payment
Our online store uses Shopify for checkout and payment processing. Use a payment method you are authorized to use. Your order receipt confirms that we received your order. We accept an order for food when we confirm it has shipped or is ready for pickup. We accept a gift card order when we issue the card.
We may decline or cancel an order for a specific reason, including unavailable stock, a material listing error, an unsupported delivery address, failed payment, suspected fraud, or a legal restriction. We will contact you using the details you provided and promptly return any payment for items we cancel. We may set reasonable quantity limits and explain them before purchase whenever possible.
5. Prices, taxes & promotions
Prices are in U.S. dollars unless clearly stated otherwise. Your checkout shows the order total, applicable taxes, shipping charges, and discounts before you pay. Any optional tip is your choice and is shown separately.
Prices and offers can change for future purchases. If we discover a material error affecting your order, we will explain it and offer the correct terms or cancel and refund the affected purchase. We will not increase a submitted order’s charge without your agreement.
Discount codes, giveaways, and other promotions follow their stated eligibility, dates, limits, and combination rules. Separate promotion rules control that promotion when they differ from these terms. A discount on merchandise does not reduce a gift card’s purchase price unless the offer expressly includes gift cards.
6. Changing or canceling an order
Email info@vttortillaco.com with your order number as soon as you need to change an address, item, or order. We will help where the order’s preparation and shipping status allow. Once an order has shipped, we may be unable to stop or redirect it.
We will confirm whether your requested change or cancellation was completed. Any added charge requires your agreement. This process does not limit cancellation or refund rights provided by law, including rights when shipment is delayed.
7. Shipping, delivery & pickup
Delivery areas, shipping options, charges, and any included-shipping offer are shown with the product or at checkout. Transit estimates describe the time in the carrier’s network; order preparation time is separate. A delivery date is an estimate unless we expressly promise it. Pickup must be arranged with us before you arrive.
We will ship within the stated shipment timeframe or, if none is stated, within 30 days after receiving a properly completed order. If we cannot, we will tell you, provide an updated timeframe if available, and give you the choice of agreeing to the delay or canceling for a prompt refund. We will cancel and refund if we cannot obtain consent required by law.
Please provide a deliverable address and arrange to receive and store perishable food promptly. If a package is missing, damaged, or arrives with a quality problem, contact us with your order number. We will help investigate with the carrier and resolve the order under our refund policy and applicable law. A carrier’s involvement does not remove our responsibilities to you.
8. Quality, returns & refunds
We stand behind our tortillas. Because they are perishable, we do not accept physical returns or exchanges. If something is wrong with your tortillas, we offer a refund or a replacement order. You do not need to send the tortillas back.
Email info@vttortillaco.com with your order number and a brief description. Photos and the package’s lot information can help us understand a problem when available. Please get in touch promptly so we can help while the details are fresh.
Refunds go to the original payment method where possible. If you paid part of an order with a gift card, that portion is generally returned as gift card credit, subject to any right to cash redemption. We will confirm the resolution and refund amount. Bank processing can affect when a refund appears. See our Returns & Refunds Policy for the current policy. These terms do not replace remedies the law gives you for defective, unsafe, misdescribed, or undelivered goods.
9. Caring for your tortillas
Follow the storage, refrigeration, freezing, and preparation directions on the product’s label. Check the package when it arrives. If you believe food is spoiled, contaminated, or otherwise unsafe, do not eat it; contact us for help.
Our recipes and educational articles offer cooking ideas and general information. Ingredients and equipment you supply have their own instructions and risks. Use appropriate kitchen care, check ingredients for your needs, and follow any safety or recall notice we provide.
10. Gift cards & giving tacos
Purchased Vermont Tortilla Company digital gift cards hold a balance in U.S. dollars for purchases through our online checkout. They are issued after payment is confirmed and delivered to the email address chosen during purchase. Please check recipient details carefully and contact us if delivery goes astray.
Purchased gift-card balances do not expire, and we do not charge maintenance or inactivity fees. A card can be used across eligible purchases until its balance is spent; you can pay an amount above the available balance with another accepted payment method. Gift cards cannot be used to buy another gift card. They are not redeemable for cash except where the law requires it, including applicable small-balance redemption rights. Contact us to request a legally required cash redemption.
Keep the gift link and code private, because someone with access may be able to spend the balance. If either is lost or exposed, contact us promptly. With proof of purchase, we can investigate and help protect or restore an unspent balance where possible. We may temporarily restrict a card while investigating suspected fraud, without removing a lawful holder’s rights.
A change-of-mind refund is not generally available after a card is issued, except where required by law. Contact us about duplicate purchases, delivery errors, or unauthorized transactions so we can review them. Any approved refund must account for value already redeemed. Promotional credits provided without payment may have separately disclosed conditions; those conditions do not change the value of a purchased card.
11. Wholesale & purchases from other sellers
Restaurants, retailers, and distributors can contact us through our Wholesale page. Wholesale pricing, minimums, delivery, payment, and resale arrangements are established in the quote or agreement we accept together. Retail orders do not by themselves appoint someone as an authorized distributor or license our branding.
If you bought our tortillas from another retailer, that seller handles its transaction and return process. You can still contact us directly about product quality or safety; the seller’s policies do not eliminate rights you may have against us under law.
12. Privacy & communications
Our Privacy Policy explains the information used for orders, gifts, inquiries, and website services, along with your privacy choices. Please share another person’s delivery or contact information only when you have permission or another lawful basis to do so.
We use the contact details you provide for receipts, order updates, gift delivery, and customer support. Marketing choices are separate. You can unsubscribe from promotional emails using their unsubscribe link. Purchasing a gift for someone does not sign that person up for marketing.
These terms alone do not enroll you in marketing texts or recurring purchases. If we offer either, the enrollment will state the applicable consent, charges, frequency, cancellation method, and program terms before you sign up.
13. Our name, recipes & creative work
Our branding, photographs, original writing, page designs, and other protected website material belong to us or their respective owners. You are welcome to browse, cook from our recipes, print material for personal use, and share links to our pages.
Ask for permission before republishing substantial protected material, selling it, or using our name or logo to suggest a partnership or endorsement. These terms preserve fair use and other uses permitted by law; they do not claim ownership of cooking methods, facts, or your independently created work.
14. Reviews, photos & suggestions
We welcome honest feedback. You keep ownership of your reviews, photos, and other original contributions. If you submit something for public display through a feature we provide, you give us a nonexclusive, royalty-free license to host, display, and format it for that feature. We will seek separate permission to use your contribution in advertising beyond that purpose.
Share only material you have the right to share. We may remove spam, unlawful material, private information, impersonation, or content that infringes another person’s rights. We do not prohibit or penalize honest negative reviews. Private support messages are handled under our Privacy Policy.
You are welcome to suggest improvements. Unless we agree otherwise in writing, we may act on a suggestion without paying for the idea, but this does not transfer ownership of your protected work to us.
15. Respectful & lawful use
Please use our site and services lawfully. Do not commit payment or gift-card fraud, impersonate others, send threats or unlawful harassment, introduce malicious code, access accounts without permission, harvest personal information, or bypass security and purchase limits. Automated activity must respect access restrictions and must not disrupt the site.
We may restrict access when reasonably necessary to address a violation, protect people or systems, comply with law, or stop fraud. Where practical, we will explain the reason and provide a way to contact us about a mistake. Restrictions do not erase refunds, valid gift-card balances, or other rights you already hold. You can stop using our website at any time.
16. Other services & outside links
Our site may connect to payment providers, social networks, maps, or other independently operated services. Those providers have their own terms and privacy practices. A link does not mean we control the destination or endorse everything on it.
For a purchase directly from another seller, contact that seller about its transaction. For an order from Vermont Tortilla Company, contact us even when Shopify or another provider handles part of the process. Using a service provider does not change our obligations as your seller.
17. Website availability & corrections
We maintain the website with reasonable care, but maintenance, technical faults, and events outside our reasonable control can interrupt it. General website tools and editorial content are provided as available, without a promise that every function will always work or that every page will be free of errors. To the extent the law allows, we disclaim implied warranties for those tools and editorial content.
This website disclaimer does not apply to warranties for the food we sell, our product descriptions, our quality and refund commitments, or your statutory rights. We may update pages and retire features, while continuing to address existing orders and obligations. If a disruption affects fulfillment, the shipping and refund provisions above apply.
18. Responsibility & limits
Each of us is responsible for harm we cause to the extent provided by applicable law. Where legally permitted, we are not responsible for indirect business losses, such as lost profits or business opportunities, arising from use of the website that were not reasonably foreseeable when the relevant agreement was made.
No provision limits liability for fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence or an unsafe product, or any liability that cannot lawfully be limited. Your rights concerning product safety, applicable warranties, privacy, payment disputes, and required refunds remain intact.
If your deliberate unlawful use of the site or knowing infringement of another person’s rights causes a third party to make a claim against us, you are responsible, to the extent permitted by law, for the reasonable direct costs attributable to that conduct. This does not require you to cover our own fault. We will notify you of such a claim and will not agree to an obligation on your behalf without your consent.
19. Resolving concerns & governing law
If something goes wrong, we would like the chance to put it right. Email info@vttortillaco.com with a description and any relevant order number. Contacting us is not a condition for exercising your legal rights.
Vermont law and applicable U.S. federal law govern these terms, without using conflict-of-law rules to remove mandatory consumer protections where you live. Subject to those protections, disputes may be brought in the state or federal courts with jurisdiction in Chittenden County, Vermont. You may also use any court, small-claims process, regulator, or other remedy available to you under applicable law.
These terms do not require private arbitration or waive your right to participate in a class action, seek a jury trial where available, or make a complaint to a public authority.
20. Updates & the rest of the agreement
We may update these terms as our business or legal requirements change. We will publish the revised text and effective date here. For a material change affecting an ongoing service, we will give reasonable advance notice and obtain renewed agreement when required. Changes apply from their effective date. An order remains governed by the terms accepted for that order unless you agree otherwise or the law requires a change.
These terms, the purchase information presented before your order, the incorporated policies, and any separate agreement we both accept form the agreement for the matters they cover. If one provision cannot be enforced, the rest continues where legally possible. A delay in enforcing a right is not a waiver of it. Ending website use does not end obligations or rights that by their nature continue, including payment, refunds, ownership, and resolution of existing disputes.
